Nepal’s Supreme Court Orders Protection of Displaced Children’s Rights

Nepal’s Supreme Court has issued an interim order directing the government to ensure the education, health, and housing rights of displaced children.

The order, issued by a single bench of Justice Sapana Pradhan Malla on Shrawan 18, 2083, states that the displacement of children has severely affected their education and that the government must ensure their access to basic services.

The court’s decision came in response to a writ petition filed by Tilottam Paudel, chairperson of the National Campaign for Education, and Barun Basyal, among others, on behalf of the Informal Sector Service Centre (INSEC) Bagmati Province Office.

Ensuring Education and Health Services

The court has ordered the government to identify and certify displaced children and ensure their enrollment in nearby schools by the end of Shrawan. The government has also been directed to provide free textbooks, uniforms, educational materials, transportation facilities, and counseling services to displaced children.

In addition, the court has ordered the government to provide necessary support services for children with disabilities and to ensure the provision of quality temporary housing and health services for displaced children, pregnant women, and the elderly.

Implementation of the Order

Tilottam Paudel, chairperson of the National Campaign for Education, has welcomed the court’s decision, stating that it will make a significant contribution to protecting the rights of displaced children. He emphasized the need for effective implementation of the order and called for the active cooperation of all stakeholders, including the government.
